1. Acceptance of Terms

The Nesher platform is a product of Scrow LLC, a limited liability company organized under the laws of the State of Delaware, United States ("Scrow LLC", "Nesher", "we", "us"). By accessing or using the Nesher managed drone security-operations platform ("Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Platform.

2. Service Description

Nesher provides a managed, dedicated SaaS environment for drone fleet operations, live video streaming, autonomous missions, and AI analytics. Nesher handles infrastructure and updates, while the Customer remains solely responsible for the physical operation and legal compliance of all flights.

3. Aviation Regulatory Compliance

3.1 Remote Flight. Remote flight beyond visual line of sight (BVLOS) is regulated in most jurisdictions. You represent and warrant that all flights conducted via the Platform comply with applicable local aviation regulations (e.g., FAA Part 107 in the US, EASA regulations in the EU).

3.2 Pilot in Command. A licensed pilot with the physical remote controller must remain capable of taking over physical control of the aircraft at all times. The Nesher platform is an augmentation to, not a replacement for, the legal pilot in command.

4. Data & Privacy

Customer retains all rights to data ingested into their dedicated instance. Nesher's responsibilities regarding data processing and security are governed by the Security & Data Processing Overview.

5. Limitation of Liability

To the maximum extent permitted by law, Scrow LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from drone accidents, regulatory fines, data loss, or system unavailability. The Platform is provided "as is" and "as available".

6. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.
